The vast bulk of legal sports betting in the United States takes place online. While online betting is not new, any website or app outside Nevada that offered sports betting in the United States prior to 2018 did so illegally.

In 2024, North Carolina became the 30th state to provide online sports betting, upgrading its offerings on March 11. These states (together with Washington, DC, and Puerto Rico) now have legal, regulated sports betting industries.

Some tribes in New Mexico, North Dakota, Washington, and Wisconsin allow sports betting through an existing Class III gaming compact.

States are still looking into sports betting legalization and regulation as a way to increase tax revenue and solve responsible gaming concerns.

In recent years, several states reviewed sports betting bills but failed to bring them across the finish line:

• Alabama: In 2024, Alabama's Senate versions of a bill failed to pass the House. Prospects looked hopeful until sports betting was stripped from a lottery plan that ultimately failed.

• California: In 2022, a ballot initiative to authorize mobile wagering failed with fewer than 20% voter support in California. Tribal gambling interests shape the future of sports betting in the Golden State.

• Georgia: Several laws were close to passing but failed due to political constraints. A proposal went through the Senate in 2024, but the House was unable to reach an agreement at the conclusion of the March session.

• Minnesota: In Minnesota, a hopeful legislative push failed in late 2023-2024.

• Mississippi: Sports betting is permitted in Mississippi, but only available in person or online at sportsbooks. The House passed a measure during the 2024 session, but it died in the Senate's conference committee.

• Missouri: Sen. Denny Hoskins of Missouri has been blocking sports betting legislation for three years due to his desire to incorporate video lottery terminals (VLTs), leading to frustration. In November 2024, voters may have the opportunity to vote on a ballot initiative.

• Nebraska: In Nebraska, new legislation filed during a special session may legalize online sports betting, in addition to the existing retail option.

• Oklahoma: In Oklahoma, sports betting is supported by many parties, including the governor. However, passing a measure that meets the needs of both tribes and legislators has proven difficult.

• Texas: In 2023, the Texas House enacted a bill legalizing sports betting, marking a first in the state. The bill quickly stopped in the Senate and will not be considered again until 2025, when the legislature reconvenes.
